이행기 정의와 비극 : ｢저기 소리 없이 한 점 꽃잎이 지고｣ 다시 읽기

본고는 87년 민주화 이후, 그 이전과 이후를 연결하는 새로운 사회 정의(正義) 정립 문제와 관련하여 문학이 고유하게 수행할 수 있을 한 기능을 살펴보고자 한다. ‘이행기 정의(transitional justice)’라 명명되는 새로운 사회 정의 정립 문제는, 요컨대 ‘과거청산’의 과제 앞에서 피해와 가해, 보복와 용서와 같은 좀처럼 종합 불가능한 이분법에 교착되어 있다. 어느덧 민주화 이후 30여 년이 지난 오늘날, 이행적 정의는 ‘화해’를 키워드로 ‘회복적 정의’를 지향하지만, 여전히 ‘진실’을 부르짖는 피해자들의 눈물을 고려했을 때 오늘날 정의는 ‘응보적 정의’에 조차 미달해있는 셈이다. 본고는 위와 같은 공동체 수준 내 응보적 정의와 회복적 정의 둘 사이 존재하는 아포리아 가운데, 이 두 정의 사이를 새롭게 매개할 ‘개인’ 내적 수준의 응징과 용서, 책임의 한 양태를 살펴보고자 한다. 역사와의 부단한 마주침 속에서 정립되는 ‘사회적 수준’의 정의 정립 과제에 앞서, 저 과제에 직간접적으로 참여하는 ‘개인의 태도’가 섬세하게 고찰되었을 때, 이는 기존 이행적 정의의 이분법적 교착을 넘어설 수 있는 예비적 단계가 될 수 있기 때문이다. 본고는 최윤의 소설 ｢저기 소리 없이 한 점 꽃잎이 지고｣ 재독을 통해, 국가 폭력 이후의 삶 가운데, 한 개인 내에 존재하는 부채의식을 비롯, 스스로에 대한 과잉된 감정들과 관련하여 이를 정직하게 마주하고, 나아가 이를 그 누구의 것도 아닌 자신의 것으로 ‘소유’해나가는 특수한 한 과정을 살펴본다. 본고는 ‘비극’의 태도라 명명할 수 있을 위 과정이야말로 오늘날 이행적 정의의 새 국면을 위한 한 계기적 기능을 수행할 수 있다고 주장, 사회 정의 정립 문제에 있어 문학 고유의 한 기능을 증명하고자 한다.

This paper aims to demonstrate the function that literature can uniquely perform in relation to the issue of establishing new social justice after democratization. The issue of establishing a new social justice, called ‘transitional justice’, is, in short, stalled in a rarely-agreed dichotomy such as damage/infliction, retaliation/forgiveness in the face of the task of “past liquidation.” More than 30 years after democratization, transitional justice aims for “restorative justice” under the keyword “harmony,” but today justice falls short of “retaliatory justice” considering the tears of victims who still cry for “truth.” This paper examines a form of 'personal' level punishment, forgiveness, and responsibility that will be newly mediated between these two definitions, among the aporia that exists between 'retaliatory justice' and 'restorative justice' within the above community level. Prior to the task of establishing a definition of “social level” established in constant encounters with history, when the “individual attitude” directly or indirectly participating in that task is carefully considered, this can be a preliminary step beyond the dichotomous deadlock of the existing transitional justice. By rereading Choi Yoon's novel, the paper examines a particular process in which an individual faces these honestly and 'owns' them as his own, with regard to the sense of debt and excessive feelings of self in his post-violence life. This paper argues that the above process, which can be called the attitude of 'tragedy', can perform one instrumental function for the new phase of transitional justice today, thereby proving a literary unique function in social justice establishment problems.
